Adjudication
Adjudication has been around for nearly 30 years after it was introduced by the Housing Grants, Construction and Regeneration Act 1996. Since then, it has become the most common method of formal dispute resolution. Unlike mediation, it’s adversarial in nature; unlike arbitration or a court claim, it’s lightning fast.
You often hear adjudication described as a “pay first, argue later” way to resolve construction disputes. What it was designed to do is protect cash flow during construction projects.

Arbitration
Adversarial in nature and a more formal process than adjudication, arbitration is a confidential alternative to court proceedings (litigation). Disputes are decided by an arbitrator with specialist construction experience.
Check your contract to see if it contains an arbitration clause. If it does, that means you will likely be required to use arbitration instead of bringing a court claim.

Mediation
Mediation is a confidential way of negotiating an agreed resolution to a dispute. A neutral third party helps parties discuss their differences and find a constructive way forward.
It is generally more cost-effective and quicker than adversarial forms of dispute resolution, and it can open the door to a far wider range of settlement options than might be the case through unassisted negotiation.
