When considering if an act has been part of contributory negligence or not. It is important to assess whether another party has contributed to that act. For example if a party is required to carry out checks before works were undertaken. Whether they failed to do so, has acted, or failed to act. Have they contributed to the breach and/ or loss in any way?

Where another party has acted in a way which has contributed to an issue or loss. This is known as contributory negligence. This is often an important point to consider.
